For good and valuable consideration described below and voluntarily accepted, retained and acknowledged by Participant, the Owner and Participant agree to the following terms and conditions: 1. Description and Date(s) of Activity(ies): Commencing May 15th, 2025 and continuing through May 19th, 2025, I (the Participant) wishes to participate in the Thresholds Retreat (the “Activity”) offered by the Owner. 2. Assumption of Risk/Fitness to Participate: The Activity may involve actions that can reasonably be considered dangerous or hazardous and Participant is under no obligation to participate in any such actions and hereby assumes all risk associated with potential injuries that may arise as a result of participating in same if Participant voluntarily chooses to proceed. 3. Consideration, Disclaimer and Waiver: In exchange for the Owner’s allowing Participant to participate in the Activity along with consideration in the amount of $10.00, and other good and valuable consideration accepted, retained and acknowledged by Participant, the Participant hereby fully releases and discharges the Owner, and the Owner’s individual owners, officers, directors, employees, agents, assigns, representatives, successors, managers, members and insurers, from any and all manner of claims, actions, debts, accounts, bonds, and demands, and all resulting damages, in connection with any personal injury or death or damage to personal property, which has been or may be sustained as a consequence of, or in connection with, Participant’s participation in the Activity, and not withstanding that such damage, loss or injury may have been caused or contributed to by the acts or omissions of the Owner. THE OWNER FULLY AND COMPLETELY DISCLAIMS ANY AND ALL LIABILITY THAT IT MAY HAVE TO THE PARTICIPANT IN CONNECTION WITH THE PARTICIPANT’S POTENTIAL INJURY, DEATH OR PROPERTY DAMAGE ARISING FROM PARTICIPANT’S INVOLVEMENT IN THE ACTIVITY. THE ACCEPTANCE AND EXECUTION OF THIS WAIVER IS MANDATORY AND THE PARTICIPANT MAY ONLY PARTICIPATE IN THE ACTIVITY IF THE PARTICIPANT VOLUNTARILY ACCEPTS THESE TERMS. 4. Fitness to Participate/Health Evaluation and Warranty: By participating in the Activity, the Participant warrants that he or she is sufficiently fit, healthy and able to take part in strenuous activities and has no physical limitations, medical ailments or physical or mental disabilities that would limit or prevent the Participant from undertaking the Activity. If required by Owner, any Participant may be subject to medical examination and clearance and Owner reserves the right to prevent any Participant from participating if Owner determines, in its sole discretion, that Participant is unwell or unlikely to be able to safely participate. 5. Reviewed and Understood: By signing below, the Participant acknowledges that i) Participant was provided adequate time to review and consider the terms and conditions of this Agreement; ii) Participant did read and understand the terms and conditions of this Agreement; iii) Participant willingly and voluntarily enters into this Agreement; iv) Participant acknowledges its complete waiver of claims and damages against the releasees identified above for any injuries or damage suffered; and v) Participant agrees to participate in the Activity and assumes all risk of loss or harm associated therewith.
